These terms of service, published by ULTRA-VPN LTD, the owner of the internet resource https://ultravpn-ltd.com (the Contractor), are addressed to any internet user (the User) and constitute an offer to enter into a contract for the provision of services remotely.
Any action aimed at using the service, including registration in the Maick application, placing an order on https://ultravpn-ltd.com, paying for a selected plan, or any other actual use of the service functionality, constitutes full and unconditional acceptance of these terms.
1.1. Offer means the official proposal of the Contractor to conclude a service agreement under the terms set out below.
1.2. Application means the Maick client application, which establishes connections to servers whose parameters are provided by the User.
1.3. Service / Services means the set of technical, software and informational solutions provided by the Contractor, including the right to use the Application and access to its paid functionality. The Contractor does not operate the servers to which the User connects and does not sell access to them; such servers are obtained by the User independently.
1.4. Plans means the current pricing system published on https://ultravpn-ltd.com or in the Application.
1.5. Order means the User's declaration of intent to receive services by selecting and paying for a plan. The Order confirms acceptance of these terms.
1.6. Account means the User's personal account created for identification and access to the service.
1.7. Subscription means granting access to the paid functionality of the Application for a certain period, either paid or free of charge.
1.8. Personal data means information about the User processed by the Contractor in connection with the performance of this agreement and in accordance with the Privacy Policy.
2.1. Ordering and using services is carried out through https://ultravpn-ltd.com or the Application.
2.2. Payment for a selected plan means the User agrees to all terms of this offer.
2.3. By accepting the offer, the User confirms that they:
have read its provisions and accept them in full;
consent to the processing of their personal data in accordance with the Privacy Policy.
2.4. The Contractor may unilaterally amend these terms and the plans. A new version takes effect from the moment it is published on https://ultravpn-ltd.com. Continued use of the service means acceptance of the amended terms.
3.1. Current prices are published in the "Plans" section on https://ultravpn-ltd.com.
3.2. The Contractor may change pricing for new orders. Changes do not apply to already paid periods.
3.3. The User's payment obligation is considered fulfilled from the moment funds are credited to the Contractor's account.
3.4. Payment is made by the methods available on the website or in the Application, including bank cards and payment systems.
3.5. Refunds are carried out in accordance with the Contractor's internal rules and applicable consumer protection legislation. Unless otherwise provided, unused periods are not refunded.
3.6. Funds displayed in the User's account balance are not electronic money and may not be withdrawn; they may only be used to extend access to the service.
4.1. An order is placed through https://ultravpn-ltd.com or the Application.
4.2. The User must provide accurate and up-to-date contact details.
4.3. The Contractor may request additional information to verify the accuracy of the provided data.
4.4. The agreement is considered concluded from the moment the order is placed and paid.
4.5. If the User does not cancel the subscription before the end of the paid period, it is automatically renewed for a similar term at the price effective at that time.
5.1. Services are provided in accordance with the procedure established on https://ultravpn-ltd.com.
5.2. Access to the paid functionality of the Application is granted after payment is received and the subscription is registered.
5.3. During any free trial period, the Contractor may restrict or terminate service provision if the User violates these terms.
5.4. Server addresses, connection profiles and keys are added by the User independently. The Contractor does not supply them and does not verify their availability.
6.1. The User may refuse the services at any time. Cancellation is performed by turning off automatic recurring charges in the Application or by contacting support at support@ultravpn-ltd.com.
After automatic recurring charges are cancelled, the User's payment data is fully removed from the system. Services may be used again only after a new subscription is arranged.
6.2. The Contractor may suspend or terminate services in the following cases:
violation of applicable law;
transfer of account credentials to third parties, except close relatives;
attempts to bypass licence restrictions or to interfere with the operation of the Application;
repeated abuse of the free period.
6.3. The agreement remains in effect until terminated by either party in the prescribed manner.
7.1. The User undertakes not to use the service for actions that violate the law or infringe third-party rights, including spam distribution, hacking, scanning or cyberattacks.
7.2. The Contractor is not liable for:
the availability, configuration or lawfulness of the servers to which the User connects, since such servers are selected and operated by the User;
communication interruptions, equipment failures or force majeure circumstances;
data loss caused by technical failures;
connection quality, which is determined by the User's server and network operator.
7.3. In case of violation of the agreement, the Contractor may block access to the service without refund.
7.4. Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
8.1. The User consents to the processing of personal data solely for the purpose of performing this agreement.
8.2. Processing is carried out in accordance with the UK GDPR, the Data Protection Act 2018 and the Privacy Policy.
8.3. The Contractor takes the necessary organisational and technical measures to protect data, but is not liable for incidents caused by circumstances beyond its control.
9.1. The parties are released from liability for partial or full non-performance of obligations in case of force majeure, including network infrastructure failures, power outages, natural disasters, military actions and other events preventing contract performance.
10.1. These terms are governed by the law of England and Wales.
10.2. Disputes are resolved through negotiations and, if unresolved, in the courts of England and Wales.
10.3. Invalidity of any provision does not invalidate the document as a whole.
10.4. The current version of these terms is published on https://ultravpn-ltd.com, with the date of the latest update indicated at the end of the document.
